The software provided by Kepware Technologies covered by this document
known as: Oracle Connectivity Suite, referred
to from this point as "the Software" is acknowledged
to be in a preliminary or "BETA"
condition. Admittance to the BETA software program of Kepware Technologies,
Inc. will be granted to the following party:
<Company Name> referred
to from this point as "the BETA Site".
Usage
Kepware Technologies, Inc. grants the BETA Site use of the Software
for the purpose of product evaluation and testing. The Software
cannot be utilized by the BETA Site in any production or operational
facilities where loss of product or person injury may result. Use
of the Software as it pertains to testing in production environment
is allowed as long as all aspects of the production system are
under test or development. The BETA Site cannot ship or transfer
from its premises the Software for use on systems not directly
under the BETA Site's control.
Disclaimers
The BETA Site acknowledges the condition of the Software as BETA.
As a BETA the Software may contain errors, may not function in
all circumstances, may not be documented, and has not been tested
to the full extent of Kepware Technologies, Inc. As such, Kepware
Technologies, Inc. does not guarantee that the Software will satisfy
the BETA Site's application needs, nor that the Software will be
error free. Even if the Software does not satisfy the BETA Site's
needs, or is viewed as failing to perform, in no event will Kepware
Technologies, Inc. be liable for any direct or indirect damages,
including lost profits or lost data.
